Terms Of Service
General Terms:
The Artist reserves the right to refuse any Commission request, without needing to explain the reason. The Artist will inform The Client if the commission request had been accepted or rejected.Prices are subject to change depending on the difficulty of the commission and additional requests.---
Copyright Usage- I, The Artist:Reserve the right to cancel and refund the order at any time for any reason.
Retain all copyrights over the commissioned artwork.
Will not profit further from the commissioned artwork unless (The Client) breaks any of the Terms of Service.
Reserve the right to stream commissions in progress unless discussed otherwise.
Reserve the right to post the commissioned artwork online (With Watermark) and in my portfolio.- You, The Client:Commissioned the Artist for artwork that is for Personal Use* or Commercial Use* only.
May upload the commissioned artwork on any website and social channels with proper credit to I, The Artist.
May not make profits from the commissioned artwork (Reselling, redistributing, prints, etc.)
May not alter the commissioned artwork without the Artist's consent.
May not use the commissioned artwork for Commercial Use* without the Artists Consent.
May not sell the commissioned artwork as NFT (Non-fungible Token)
May not to use the commissioned work in training any AI (Artificial Intelligence) or ML (Machine Learning) models.
Agree that if the commissioned artwork is for Commercial Use, additional fees will be included in the overall price of the commission.The following is considered copyright infringement:
Whoever used any copyright works without consent or authorization from the author, copyright owner, and performer, it may constitute an infringement under Copyright Act 1987. The act of infringement includes:Reproduction in any material form or distributes to the public.
Imports any work for the purpose of trade or financial gains.
Sell or rent any infringing copy without The Artist's consent.
Exhibits in public any infringing copy by way of trade.---
Cancellation & Refund
The Client is free to cancel the commission at any time during the process of creating the commission; however, the first invoice will not be refunded as accommodation for the artist's time and labor.The Artist is free to cancel the commission at any time during the process of creating the commission; however, the unfinished artwork files and sketches will be submitted to the client as compensation for the commission.---
Terms and Definitions
*Personal Use
Used for personal enjoyment as opposed to business or investment purposes, not to be used for profit or commercial gain.*Commercial Use
The use of certain merchandise, tools or intellectual property for financial gain. Intended for promotional, marketing or advertising a service, person or business.
Information
-Commissions are first come, first served. If you (The client) need a commission done within a specific deadline, please note that in the required field. I (The artist) will let you know if I am available to work on your commission sooner. However, you will also be charged for a rush fee of 200% the total price of the commission if the sooner lead times and deadlines are agreed upon.-Once your request is approved, I will send a confirmation email/Direct Message. Once I am available to start work on your commission, an Invoice will be sent to your attention using the email you provide. I will ask for full payment before starting your commission. Payment will be through PayPal. Payment will be in US$ Currency. Payment must be made within 48 hours after an invoice is received. Payment plans are only available for commissions of value 170$ or higher.-Once payment is received, a confirmation email/Direct Message will be sent. Another email/Direct Message will be sent including multiple sketches. During this time, you are allowed major revisions, you are allowed to cancel for full refund as long as it is within 6 months from the time the invoice is paid and the commission is not part of a payment plan and if the commission is unfinished. Once a sketch or multiple of sketches are approved, I will proceed with finishing your commission. If a payment plan is included in your commission, the next payment must be made prior to me working on the next phase.-Throughout the time I work on the final phase of your commission, I will send you multiple progression emails/Direct Messages. During this time you are allowed minor revisions, you will no longer be able to request a full refund. Once finished, I will send a final progression email/Direct Message of a trademarked version of your commissioned piece. Once the piece is approved I will send a final signed version of your commissioned piece (.png and .jpg). If a payment plan is included in your commission, the final payment must be made prior to receiving the final commissioned piece. If changes are required after final approval, additional invoices will be sent to you that are required to be paid in full before the changes will be made.In Short:
Application -> Approval Confirmation -> Waitlist -> Open Availability / Invoice sent -> Invoice Paid/First Payment -> Confirmation -> Sketches for Approval/Approved Sketches -> Next Invoice Paid(If required) -> Progression/Final Approval -> Final Invoice Paid(If required) -> Finalized Artwork/Commission Received.
